Abstract

Abstract: The judgment that will be studied in this thesis refers to a civil problem, since it deals with a real estate located in the Canton Daule of the Province of Guayas. In the aforementioned judgment, an analysis is made of the right to property, legal security and due process that must be present in all trials as determined by the Constitution. In the case under study, the Prefecture of Guayas intended to make the donation of a real estate property owned by Mrs. Elsie Verenise Ronquillo Ronquillo, without taking into consideration the title of ownership held by the affected person, who filed a protection action without taking into account that it was a matter of civil and not constitutional character, so the Court accepted the extraordinary protection action and left without effect the judgments issued in the first and second instance. The Constitutional Court refers to different jurisprudences, which determine that the protection action is presented to protect the rights established in the Constitution and that the jurisdictional bodies must be consulted when one of these protected rights is being violated. In the case under review, the affected party claimed that the right to property established in the Constitution was being violated. Development Objective number 16 promotes that people have access to justice and that there are effective and solid institutions that can respond to the requirements of people, especially with regard to the Administration of Justice.
