The systematic method has been used to compile related information from previous research in order to scientifically acquire new knowledge, in this case understanding how the ruling of the constitutional court is related and the effects that it has generated in the development of justice. in Ecuador; and the exegetical method that allows us in a certain way to interpret the laws and norms related to the inexcusable error and understand why the constitutional court accepted the request for the protection action and the court determines the conditional constitutionality of the aforementioned article, as long as there is a declaration prior jurisdiction.
