| Abstract: | Abstract: There are different instruments that guarantee equitable justice in the world, in our country one of the guaranteeing elements of the aforementioned concept is the Constitution of the Republic of Ecuador, in it we find different articles where judicial protection is guaranteed, the guarantee of defense and legal security. The objective of this work is to analyze how the concept of judicial protection has been carried out in the case studied, for which we will resort to research in different media, literature, internet pages, labor code, constitution of the republic of Ecuador, magazines, blogs, interviews with labor lawyers. Based on this investigation, we will have as a result an analysis of judicial protection in the labor field together with an analysis of the guarantee of the defense and legal security of workers' rights. These analyzes will lead us to the conclusions of this work in which we will show how legal security and judicial protection are conceptualized by our professional colleagues. |
| Description: | Resumen: Diferentes son los instrumentos que garantizan una justicia equitativa en el mundo, en nuestro país uno de los elementos garantizadores del concepto antes mencionado es la Constitución de la República del Ecuador, en ella encontramos diferentes artículos donde se garantiza la tutela judicial, la garantía de la defensa y la seguridad jurídica. El objetivo del presente trabajo es analizar cómo se ha llevado a cabo el concepto de la tutela judicial en el caso estudiado para lo cual recurriremos a investigación en diferentes medios, literatura, páginas en internet, código laboral, constitución de la república del Ecuador, revistas, blogs, entrevistas con abogados laboralistas. Con base en esta investigación tendremos como resultado un análisis sobre la tutela judicial en el campo laboral juntamente con un análisis de la garantía de la defensa y seguridad jurídica de los derechos de trabajadores. Estos análisis nos llevarán a las conclusiones del presente trabajo en las cuales evidenciaremos como está conceptualizada la seguridad jurídica y tutela judicial por nuestros colegas profesionales. |
