Abstract

This paper discusses the legal notions of violence against women and members of the family nucleus from the Constitution and the Comprehensive Criminal Organic Code, analyzing practical and field cases that seek to investigate the obligation to act with due diligence before acts of violence against women and how legal, political, administrative and cultural measures should be taken to promote the safeguarding of human rights and to ensure that any violations are effectively considered and treated as an unlawful act that is suscept ible of carrying penalties for whoever commits them, as well as the obligation to compensate the victims. The adequate, reliable and scientifically guaranteed protocol of forensic psychological evaluation in ill-treatment situations is disclosed, in which three aspects or areas of assessment must be taken into account. It will culminate in establishing the conclusions and recommendations that arise from the fulfillment of the objectives and the verification of the hypothesis
