Abstract: The nullity is a procedural act that occurs in the legal field as a result of failure to comply with the conditions of an act, whether by deliberate the judge's action or lack of observance of the forms defined in the law. The irregularity in the essential procedural form is sufficient cause for the nullity of an act or a sentence appropriate, either ex officio or at the request of one of the injured part. Ecuadorian legislation determines precisely the causes of invalidity that produce inefficiency or legal value of the legal act and is made concerning the violation of the solemn ceremonies of the essential procedural form. The code of Civil Procedure refers to the procedural nullity as well as the actions necessary to remedy them. This paper discusses the annulment of order procedures, making relationship to the causes that provoke it and the effects resulting from its Declaration, as well as given by the legal order required forms to contest a procedural act or a procedural form is sufficient cause for the nullity of an act or a sentence appropriate, either ex officio or at the request of one of the injured part. Description: La nulidad es un acto procesal que se da en el campo jurídico como producto de la inobservancia de las condiciones necesarias, ya sea por acción deliberada del juzgador o por falta de observancia de las formas estipuladas en la ley. La irregularidad en la forma procesal esencial es causa suficiente para que la nulidad de un acto o de una sentencia proceda. En la legislación ecuatoriana se determina de forma precisa las causas de nulidad que producen ineficacia o valor legal del acto jurídico y se hace relación a la violación de las solemnidades de la forma procesal esencial. El Código de Procedimiento Civil Ecuatoriano hace referencia a las nulidades procesales así como a las acciones necesarias para remediarlas. La tesis analiza la nulidad de orden sustantivo y procesal, haciendo relación a las causas que la provocan y los efectos que conlleva su declaratoria, así como a las formas necesarias dadas por el orden jurídico para impugnar un acto procesal o una sentencia, por falta de requisitos que precisa el acto procesal y las formalidades establecidas como indispensables.
