Estudio comparado y socio- jurídico de la unión de hecho desde el caso ecuatoriano con el Perú

Abstract

This research is important because it allows to enhance the academic and research integration of the comparative and socio-legal study of the common law marriage. It should be noted that the constitutional elements from the Ecuadorian and Peruvian legislation have some similar characteristics. In the Ecuadorian code as in the Peruvian one, the common law marriage is contemplated when more than two years of coexistence have been elapsed, provided that the cohabitants are free of marriage link and in agreement.. The appliance of surveys and interviews allowed to address this issue, the common law marriage in Ecuador and Peru is regulated in the constitutions and has suffer some modifications during the last 10 years. Couples must comply with certain requirements that legalize it, although these characteristics and requirements of union for some specialists are not the most suitable. Common marriage and the common law marriage both, in Ecuador and in Peru, are two issues that demand obligations and rights. For this reason, these countries have created laws that regulate their development and allow their acceptance.
