| Abstract: | Abstract:The present work deals with the comparison of the Ecuadorian legislation with the Peruvian one in reference of the issue of the Union of Fact in which retrospective is done from the Roman beginnings to the present, for the present work the descriptive investigation was used giving it a particular approach To the subject treated, in the same way it was resorted to several research tools such as the interview and the survey, arriving to determine that the importance of the recognition of the Union of Fact, both for the Ecuadorian and Peruvian society, lies in the made of the legal protection of the rights of the cohabitants that originates in this legal situation that is increasingly common within both countries, hence the law and the State are obliged to provide protection and legal recognition and including constitutional of de facto unions, insofar as it involves relevant aspects in the protection of the family that is the nucleus of society, since that is where the origin of human life occurs. |
| Description: | Resumen: El presente trabajo trata acerca de la comparación de la legislación Ecuatoriana con la Peruana en referencia del tema de la Unión de Hecho en cual se hace una retrospectiva desde los inicios Romanos hasta la actualidad, para el presente trabajo se utilizó la investigación descriptiva dándole un enfoque particular al tema tratado, de igual manera se recurrió a varias herramientas de investigación como son la entrevista y la encuesta, llegando así a determinar que la importancia del reconocimiento de la Unión de Hecho, tanto para la sociedad ecuatoriana como para la peruana, radica en el hecho de la protección jurídica de los derechos de los convivientes que se origina en esta situación jurídica que cada vez es más frecuente dentro de ambos países, de allí que el derecho y el Estado se vean en la obligación de brindar una protección y reconocimiento legal e inclusive constitucional de las uniones de hecho, por cuanto involucra aspectos relevantes en la protección de la familia que es el núcleo de la sociedad, ya que es en donde se produce el origen de la vida humana. |
