dc.description	Resumen: El propósito del presente trabajo es dilucidar si las personas jurídicas son moralmente responsables, y si el Derecho de sociedades ecuatoriano resulta compatible con los nuevos paradigmas propios del Estado constitucional de Derechos y Justicia. Para ello se busca explicar de qué manera el asociativismo y su evolución han contribuido a la creación del concepto de sociedad comercial. A demás, mediante un análisis filosófico y jurídico, se abordará la personalidad moral, a través de las distintas teorías que buscan explicar y justificar este atributo fundamental de las sociedades de comercio. Por otra parte, se expondrá la teoría contractual e institucional con el fin de develar cuál de estas teorías resulta armonizable con la idea de la responsabilidad moral y un nuevo concepto de interés social. En tal sentido es necesario teorizar sobre la evolución del constitucionalismo ecuatoriano, sus principios y valores, y sobre todo el papel de las sociedades como agentes del desarrollo económico. Por último, se busca establecer la necesidad de la ética de las organizaciones, ética de los negocios, y la ética del desarrollo.	es_ES
dc.description.abstract	Abstract:The intention of this thesis is to elucidate if the mercantile companies are morally responsible, and if the law of Ecuadorian companies is compatible with the paradigms of the constitutional State of Rights and Justice. For this, it is sought to explain how associativism and its evolution have contributed to the creation of the concept of commercial society. In addition, through a philosophical and legal analysis, the issue of moral personality will be addressed, through the different theories that seek to explain and justify this fundamental attribute of trading companies. On the other hand, the contractual and institutional theory will be exposed in order to reveal which of these theories is harmonizable with the idea of moral responsibility. In this sense, it is necessary to theorize about the evolution of Ecuadorian constitutionalism, its principles and values, and especially the role of societies as agents of economic development. Finally, it seeks to establish the need for the ethics of organizations, business ethics, and the ethics of development.	es_ES
