Abstract

Abstract:The present degree work offers an important contribution, since an analysis and investigation on the evictions occurred in the years 2014 - 2015 and 2016; around the mining project - Viewpoint to the indigenous community called, Amazon Community of Social Action Cordillera del Condor (CASCOMI); That is located in the direct area of the Chinese capital company Ecuacorriente S.A, located in the Tundayme parish, in the El Pangui canton, in the province of Zamora Chinchipe; Therefore, the purpose of this study is to show, through the development of the subject, the rights that are recognized to the indigenous peoples, emphasizing their right over their ancestral territories, starting from the National regulations as is our Constitution of the Republic of Ecuador; ratifying through international instruments that recognize rights to indigenous peoples; The manifested legal bodies will allow us to demonstrate whether the collective rights of indigenous peoples have been guaranteed and under what legal procedures the State and the mining company have proceeded to execute the evictions around the extractive project; which have generated negative effects; At the environmental, economic, social, and cultural level, therefore, the investigation will allow us to verify the reality that the extractive project has generated within the indigenous community.
