| Abstract: | Abstract:This research work will briefly establish the definition and origin of the extraordinary protection action; In what circumstances should it be applied and what are the requirements that must be met to apply it. This study is important since the extraordinary protection action is a constitutional guarantee established in our Constitution of Ecuador. The 2008 constitution strengthened its guarantee figure, guaranteeing respect and demanding compliance with constitutional rights; as well as the rights granted in human rights. In this investigation the guarantee of the extraordinary protection action will be studied in detail, in the three specific cases; in which the importance of knowledge of the application, requirements and time in which it must be presented is noted. Cases that were analyzed with the Constitution, the Organic Law of Jurisdictional Guarantees and Constitutional Control plus its regulations. The conclusions and recommendations establish that it is important to know, handle and apply the extraordinary protection action correctly. |
| Description: | Resumen:Este trabajo de investigación de forma breve establecerá la definición y el origen de la acción extraordinaria de protección; en qué circunstancias debe ser aplicada y cuáles son los requisitos que se deben cumplir para aplicarla. Este estudio es importante ya que la acción extraordinaria de protección es una garantía constitucional establecida en nuestra Constitución del Ecuador. La constitución de 2008 fortaleció su figura garantista, avalando el respeto y exigiendo el cumplimiento de derechos constitucionales; al igual que los derechos otorgados en los derechos humanos. En esta investigación se estudiará de forma pormenorizada la garantía de la acción extraordinaria de protección, en los tres casos específicos; en los que se da a notar la importancia del conocimiento de la aplicación, requisitos y momento en el cual se debe presentar. Casos que fueron analizados con la Constitución, la Ley Orgánica de Garantías Jurisdiccionales y Control Constitucional más su reglamento. Con las conclusiones y recomendaciones se establece que es importante el conocimiento, el manejo y la aplicación correcta de la acción extraordinaria de protección. |
