Impacto de las acciones afirmativas sobre la igualdad material y la jurisprudencia de la Corte Constitucional

Abstract

Abstract: The recognition of fundamental rights that are related to people who have lived in real inequality becomes a fact that in social development allows a dignified life. The Constitution within the framework of good living and a dignified life and the right to real or material equality demands affirmative actions on the part of state authorities for the effective exercise of people's rights to freedom. In this sense, the initial purpose of these actions is the elimination of inequalities and the eradication of discriminatory acts that could be affecting people, measures that have been widely adopted in the Latin American region and in Ecuador with the entry into force of the Constitution. of 2008, in order to achieve real equality in favor of the holders of these rights who are in some state of inequality. The object of the study is to determine the impact of affirmative actions from the right to equality in its material dimension and non- discrimination. The judgments issued by the Constitutional Court referring to this mechanism are analyzed for this.
