Estudio de las sentencias sobre la acción extraordinaria de protección en el Ecuador

Abstract

Abstract: The project "Study of judgments on extraordinary protection action" is framed within the Constitutional scope, which aims to carry out a study of the judgments issued by the Constitutional Court during the years 2011 to 2016 on the extraordinary protection action with analysis normative, legal and doctrinal. With this, it is intended to develop investigative skills with the study of judicial decisions in the defense of rights, with the observations issued by the Constitutional judges, the present research was carried out based on the analysis of sentences issued in the years 2017 and 2018, the project has as objective the protection of constitutional and fundamental rights in sentences. The investigative methods used are analytical / synthetic and legal constructivism; the filing, the casuistic study, the direct observation and bibliographic review have been the techniques used. As a conclusion of the research work, it is obtained that the extraordinary protection action is applied against definitive sentences that, as a consequence of the action or omission of the ordinary justice entities, have violated constitutional rights.
