Estudio de las sentencias sobre la acción extraordinaria de protección en el Ecuador

Abstract

Abstract: The work entitled "Studies of judgments on the extraordinary Protection Action" has had the purpose of making the legal, doctrinal and legal analysis of three judgments identifying the interpretative level and weighting of the constitutional magistrates, the Private Technical University of Loja promotes active participation of the student and citizen community, reviewing the constitutional resolutions and the correct administration of justice in our country. To reach conclusions in this investigative work, three sentences were analyzed: N. 142-17 SEP-CC / Caso 0130-14-EP, N. 143-17 SEP-CC / Caso 0406-14-EP, and N. 144-17 SEP-CC / Case 1700-15-EP, resorting to the scientific method through analysis and synthesis. It was a qualitative study, understanding legal constructivism and legal interpretation with the application of. All of them to comply with the jurisdictional guarantees, concluding that the judges are the true guarantors in a judicial process so that the rights are respected and they are not violated or reversed judgments are reversed.
