Abstract:The present work contains an analysis the public administration, which is represented by entities that are part of the State, to whom citizens entrust the definition of regulatory framework and are obliged to assume their rights and responsibilities, and the State has the duty to guarantee the power is not be exceeded in the exercise of control with the purpose of been possible to live in harmonious societies. State has a Budget for the operation of government apparatus that allows it to execute works, acquire goods and services that covers the needs of the population, for which it must funnel the purchases through public purchases system, implemented by SERCOP Portal and regulated by the Organic Law of the National Public Procurement System and its regulations. It is the responsibility of state servants to observe the regulations that govern the public sector, so that all administrative acts are duly motivated, and law is specifically applied, guaranteeing trust in the institutions, fair treatment, transparency, and legal certainty.
