Abstract

Abstract: This research work revolves around the rights of nature, a healthy environment, and biodiversity, regarding their protection, care, and violations. In this sense, considering the right analyzed, it is linked to Sustainable Development Goal (SDG) No. 15, which deals with sustainably managing forests, combating desertification, halting and reversing land degradation, and halting biodiversity loss. In general, it deals with the environment. Therefore, in order to conduct an in-depth analysis of both the rights under study and the SDG, a landmark ruling by the Constitutional Court is analyzed regarding an extraordinary protection action for the violation of the right to a justification in a protection action that, from the outset, violated the rights to live in a healthy, ecologically balanced environment, the right to a safe habitat, water, sustainable development, and the city. to the rights of nature and the right to cultural heritage.
