| Abstract: | Abstract: The objective of this degree work is to analyze in an investigative manner the study of ruling No 1149-19-JP-21 linked to the subject of environmental law preference. The objective of this study is to understand the different types of violations of the rights of nature that existed within ruling No 1149-19-JP-21 issued by the Constitutional Court. Using the analytical, systematic and exegetical methodology, the sentence and doctrine will be assessed based on relevant data for the construction of this study, which aims to strengthen future law students to recognize and value the importance of Environmental Law for the protection of our ecosystems. The study of this ruling also reveals the social, economic and legal impact generated after Covid 2019 in terms of Environmental Law issues and its progress towards compliance with the 2030 Agenda. This ruling is related to the analysis of the Sustainable Development Goal No. .15 which aims to promote awareness about the sustenance of human life by guaranteeing the protection of terrestrial ecosystems. |
| Description: | Resumen: El presente trabajo de titulación tiene como objetivo analizar de forma investigativa el estudio de la sentencia No 1149-19-JP-21 vinculada con la materia de preferencia derecho ambiental. El objetivo de este estudio es comprender los distintos tipos de vulneraciones hacia los derechos de la naturaleza que existieron dentro del fallo No 1149-19-JP-21 emitido por la Corte Constitucional. Utilizando la metodología analítica, sistemática y exegética se valorará la sentencia y doctrina en base a datos relevantes para la construcción de este estudio que tiene como propósito afianzar a los futuros estudiantes de derecho a reconocer y valorar la importancia del Derecho Ambiental para protección de nuestros ecosistemas. El estudio de esta sentencia también revela el impacto social, económico y jurídico generado luego del Covid 2019 en cuanto a temas de Derecho Ambiental y sus avances para el cumplimiento de la Agenda 2030. Esta sentencia está relacionada con el análisis del Objetivo de Desarrollo Sostenible No. 15 que tiene como objetivo promover la conciencia sobre el sustento de la vida humana garantizando la protección de los ecosistemas terrestres. |
