Abstract

Abstract: This research focused on the study of a protective action ruling by the Constitutional Court of Ecuador (CC) that analyzed the violation of the right to health of a person with a disability, a constitutional right recognized in international instruments and which is also a Sustainable Development Goal worldwide. Therefore, during the research, the study methodology was systematic and exegetic, theoretical-deductive, which allowed us to link Ruling No. 328-19-EP/20 of June 24, 2020, with No. 3 of the Sustainable Development Goals in constitutional matters. Through scientific research of the legal criteria of the rights protected in Ecuadorian regulations and the Inter-American Court of Human Rights (IACHR), it allowed us to analyze the problem of the violation of the affected person's right to health, resulting in a ruling in favor of the the defendant, so that the investigation concluded that the scope of constitutional legal criteria is in the application and administration of justice to fulfill an institutional duty and provide mechanisms for judicial action that allow access to health care to be guaranteed.
