Abstract

Abstract: This research seeks to facilitate analytical understanding in labor law, mainly of the Constitutional Law and the Organic Law of the Public Service, in relation to the violation of the rights of workers and children. Its approach is based on the problem of the violation of the labor rights of pregnant women, seeking to integrate them socially and generate equal opportunities through the protection of the rights established in the Constitution. For this reason, this work develops the analysis of the constitutional framework in the face of the growing infringement of labor rights, related to SDG 5, which promotes gender equality and the empowerment of women, identifying how these legal provisions contribute to compliance of this objective. Likewise, through the analysis of the ruling 309-16-SEP-CC, it will be examined how the State is called to guarantee the effective enjoyment of these rights, facing the structural limitations derived from patriarchal visions that still persist in the workplace evidencing how public policies and judicial decisions can strengthen gender equality by protecting workers invulnerable situations.
