Abstract

Abstract: This work analyzes the judgment N° 387-17-SEP-CC of the Constitutional Court of Ecuador and its relationship with Sustainable Development Goal (SDG) N° 16, which promotes just, peaceful, and inclusive societies. It addresses the violation of rights established in Articles 216, 217, and 218 of the Labor Code and Articles 66 paragraph 4, 76 paragraph 7, and 82 of the Constitution. Employer Retirement, as a labor benefit, entails the payment of a pension by the employer when certain seniority and age requirements are met. The judgment examines the right to equality from a legal perspective, as the foundation of a fair system where all are equal before the law. Additionally, it highlights the principle of effective protection, which ensures individuals access to impartial, prompt, and effective justice to safeguard their rights. This principle is essential in democratic systems and ensures the fair resolution of conflicts and the protection of violated rights.
