Abstract

Abstract: Within the present investigative project, a jurisprudential analysis was carried out that examines Sentence No. 904-12-JP/19, issued by the Constitutional Court of Ecuador, within the case No.904-12-JP, in which it is evident the lack of medical attention to the plaintiff Jessika del Rosario Nole Ochoa, by the IESS Hospital, for which comprehensive reparation measures were ordered. This is consistent with SDG No. 3, which guarantees the right to health and well-being, whose development we will carry out with the application of the systematic method when directing cognitive theories that allows us a clear, precise and structured order to achieve the legal truth aimed at. under a jurisprudential analysis, the knowledge of the authors which form an argument under a theoretical position towards a correct interpretation, deduction and synthesis of the topic under study. The analysis was carried out based on the rights of people in health; of pregnant women, the right to priority protection and comprehensive health care and the rights of their life during the pregnancy, childbirth and postpartum process.
