Abstract

Abstract: Based on my preferred subject, which is Civil Law, I take as the object of study the ruling No. 1010-18-EP/23 of Extraordinary Protection Action issued on November 23, 2023 by the Constitutional Court of Ecuador, it is It is linked to Sustainable Development Goal number 16 Promote just, peaceful and inclusive societies , promoting access to quality justice, legal security and effective judicial protection, allowing coexistence and social development to be guaranteed while respecting the rights established in the Constitution of the Republic of Ecuador; For which various types of research methodologies and techniques were used that allowed the objective development of the degree work, based on the guidelines issued by the Private Technical University of Loja. The analyzed ruling establishes jurisprudence in the field of Civil Law directly related to contractual obligations in the private sphere, even as in the first instance, appeal and cassation rulings the right to due process was violated in the guarantee of being tried by a competent judge (kompetenz-kompetenz principle)
