| Abstract: | Abstract: In Ecuador, respect for human rights has always been violated, which has led to children and adolescents continuing to be victims of violence, abuse, and sexual harassment within the educational environment, mainly violating the rights to comprehensive sexual and reproductive education, the right to education, health, and effective protection. Within this field of research, the aim is to demonstrate the public policy applied and aimed at the protection of children and adolescents in the educational environment of the Ecuadorian State, based on the ruling of the Inter-American Court of Human Rights against Ecuador, for a case of sexual violence suffered by an adolescent in the state educational environment, the violation of judicial guarantees and judicial protection. Under this approach, the investigative work was carried out that is linked to SDG No. 16, which aims to promote peace, justice and strong institutions. This approach determines the elements that constitute the human rights safeguarded in the Objective, applying the most relevant elements for their respective protection and compliance in the development of the standard. |
| Description: | Resumen: En el Ecuador, el respeto a los derechos humanos, siempre han sido vulnerados, lo que ha llevado a que niños, niñas y adolescentes sigan siendo víctimas de violencia, abuso y acoso sexual dentro del ámbito educativo, vulnerando principalmente los derechos a la educación sexual y reproductiva integral, derecho a la educación, salud y la tutela efectiva. Dentro de este campo investigativo, se trata de evidenciar la política pública aplicada y encaminada a la protección de los NNA, en el ámbito educativo del Estado ecuatoriano, a partir de la sentencia de la Corte Interamericana de Derechos Humanos frente a Ecuador, por un caso de violencia sexual sufrida por una adolescente en el ámbito educativo estatal, la violación de las garantías judiciales y a la protección judicial. Bajo este enfoque, se realizó el trabajo investigativo mismo que se vincula al ODS Nro. 16, que tienen como meta promover la paz, justicia e instituciones sólidas. Este enfoque determina los elementos que constituyen los derechos humanos precautelados en el Objetivo, aplicando los elementos de mayor relevancia para su respectiva protección y cumplimiento en el desarrollo de la norma. |
