Abstract

Abstract: The present curricular research work analyzes the Judgment No. 262-16-SEP-CC of the Constitutional Court of Ecuador, in relation to the extraordinary protection action filed by the company CONSTRUMILLENIUM S.A. against the judicial bodies of the Specialized Chamber for Family, Women, Children, and Adolescents of the Provincial Court of Justice of Guayas, the Civil Judicial Unit based in the Duran canton of the Guayas province, and the Decentralized Autonomous Municipal Government of the Duran canton. Consequently, this paper focuses on the study of the implications of Sustainable Development Goal No. 16 in terms of legal certainty and access to justice, which aims to promote peaceful, inclusive and just societies. The study reveals the importance of having effective judicial protection, through solid, inclusive and transparent institutions. Likewise, the analysis and study of the selected judgment shows how the lack of effective judicial protection, a consequence of corrupt institutions, restricts the fundamental freedoms of society in general. Finally, recommendations are issued related to the institutional strengthening of the Ecuadorian justice system to promote the rule of law in Ecuador.
