Abstract

Abstract: The paper examines the human rights violations in the Montesinos Mejía vs. Ecuador case, where the main objective was to analyze how these violations reflect the need to strengthen the Ecuadorian judicial system and guarantee effective access to justice, in line with the Sustainable Development Goals (SDGs), especially SDG 16. The methodology had a qualitative approach, including the review of relevant literature and the analysis of sentences, which made it possible to identify the constitutional and conventional norms that were violated. The results obtained indicate that Ecuador failed to comply with its international obligations, affecting fundamental rights such as personal liberty, physical and psychological integrity of Montesinos, as well as the rights of the victims. The conclusions underline the urgency of promoting the independence and impartiality of judges, as well as the need to effectively investigate allegations of torture. In addition, the importance of implementing preventive measures to avoid future human rights violations is highlighted, and it is proposed that the training of future lawyers include a focus on human rights and social justice, contributing to a more just and peaceful society.
