Abstract

Abstract: This project is based on the analysis of a ruling on the case of a minor patient who was denied specialized medical care by the IESS of Azuay. The reason assigned was that the minor did not have medical coverage because the parent was not affiliated with Social Security, and that, due to family problems since she suffered from alcoholism, the Cuenca cantonal protection board gave custody to his maternal grandfather, who was affiliated with the IESS. On the other hand, the denial of medical care from the IESS motivated a legal dispute that reached the Constitutional Court. Whose analysis issues a ruling resolving the case, in the Plenary on November 22, 2017, where it declares that there was a violation of the right to health and indicates that the respective reparation measures must be applied to the minor. Also granting the guarantee of non-repetition, establishing a jurisprudential precedent. Likewise, it guarantees health service coverage for vulnerable people, and also ensures the right to social security, thus fulfilling sustainable development goal 3.
