Motivación de sentencias emitidas por los jueces de primer nivel en el Ecuador

Abstract

Abstract: This thesis analyzes the importance of a properly reasoned judicial decision, focusing on the role of the judge in resolving a case. It examines how sufficient reasoning is not only a constitutional and procedural requirement but also an essential guarantee for effective judicial protection, due process, and legal certainty. The work focuses on the study of a labor case processed before the Judicial Labor Unit of Loja, in which it was determined that the decision issued by the judge was properly reasoned by integrating proven facts, regulatory grounds, jurisprudence, and logical reasoning. The research was conducted with a qualitative approach, employing content analysis of judgments and relevant legal doctrine. Among the main findings, it is highlighted that a judicial decision without reasoning or with apparent reasoning can be considered null and void, so the judge's role as guarantor of rights requires a clear, coherent, and legally supported justification. It is concluded that a judicial decision, when properly reasoned, strengthens the legitimacy of the justice system and protects the rights of the parties to the proceedings.
