| Abstract: | Abstract: In this research, I am conducting a study of the motivation of the sentence issued by the First Criminal Court of Cañar in the process No. 03204-2021-00984. The main objective of the study is to analyze and evaluate the correct and sufficient motivation of the aforementioned sentence. It should be noted that this research is part of a general project proposed by the UTPL Law School, which consists of analyzing and evaluating the motivation in the sentences issued by first level judges in Ecuador. The methodology used is the analysis of the motivation of sentences that follows the analytical method. The results obtained by applying the questionnaire of sufficient and correct motivation allowed us to conclude that the sentence under study complies with the guarantee of motivation. It is concluded that the analysis and evaluation of the motivation of sentences allows students to establish a mechanism of academic control of the work done by judges. |
| Description: | Resumen: En esta investigación realizo un estudio de la motivación de la sentencia que emitió el Tribunal primero de lo Penal del Cañar en el proceso Nro. 03204-2021-00984. El objetivo principal de estudio se enmarca en analizar y evaluar la motivación correcta y suficiente de la sentencia antes mencionada. Cabe destacar que esta investigación es parte de un proyecto general que propone la carrera de Derecho de la UTPL qué consiste en analizar y evaluar la motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador. La metodología que se utilizó es el análisis de la motivación de sentencias que se desprende del método analítico. Los resultados que se obtuvieron aplicando el cuestionario de motivación suficiente y correcta nos permitió concluir que la sentencia objeto de estudio cumple con la garantía de la motivación. Se concluye que el análisis y evaluación de la motivación de sentencias permite a los estudiantes establecer un mecanismo de control académico del trabajo realizado por los jueces. |
