| Abstract: | Abstract: This research paper addresses the issue of motivation in court rulings, particularly in the sentence for a sexual offense that is the subject of this paper. It seeks to determine whether the motivation for the sentence issued by the judges of the Penitentiary Guarantees Court of Loja Canton was properly and sufficiently motivated. To this end, it analyzes doctrine related to the topic of motivation, a norm that has been developed in the country in this regard, relevant points in motivation standards, and the sentence itself. |
| Description: | Resumen:El presente trabajo de investigación aborda el tema de la motivación en sentencias judiciales, particularmente, en la sentencia por delito sexual objeto de este trabajo. Se busca identificar si la motivación de la sentencia emitida por parte de los jueces del Tribunal de Garantías Penitenciarias del Cantón Loja fue motivada de manera correcta y suficiente, para lo cual se analiza doctrina relacionada con el tema de la motivación, norma que se ha desarrollado en el país en el mismo sentido, puntos relevantes en los estándares de motivación y la sentencia misma. |
