Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This paper provides an exhaustive analysis of the first-instance judgment in the criminal courts for the crime of illicit trafficking in controlled substances. It investigates whether the motivations for the judge's decision are fully justifiable, and whether the ruling is correct or whether there are inconsistencies or a lack of motivation for the ruling. Motivation is an important aspect, so the court's process is analyzed to determine whether it was conducted correctly and whether or not there were any irregularities or omissions from the law. Although our country's justice system remains vigilant, it is not exempt from the possibility of errors that could cause dissatisfaction among interested parties. Through the analysis carried out, results will be obtained based on the sentence under investigation, which may include verification and reasoned justification by the Judge or the presence of a legal error that may exist with the slightest omission of any formality or requirement that evades due process.
