| Abstract: | Abstract: The right to property is a fundamental right recognized in the Ecuadorian Constitution. Reasoning is an essential element in judicial decisions, as it guarantees transparency, fairness, and legal certainty. Sufficient reasoning means that the judicial decision is based on a logical analysis of the facts and the law. Correct reasoning refers to the correct application of the regulations and the precision of the argumentation. A lack of reasoning or deficient reasoning can have serious consequences for the parties involved and for the legitimacy of the judicial system. |
| Description: | Resumen:El derecho a la propiedad es un derecho fundamental reconocido en la Constitución ecuatoriana. La motivación es un elemento esencial en las decisiones judiciales, ya que garantiza la transparencia, la justicia y la seguridad jurídica. La motivación suficiente consiste en que la decisión judicial se base en un análisis lógico de los hechos y del derecho. La motivación correcta se refiere a la correcta aplicación de la normativa y a la precisión en la argumentación. La falta de motivación o una motivación deficiente puede tener graves consecuencias para las partes involucradas y para la legitimidad del sistema judicial. |
