Abstract

Abstract: The purpose of this research work is to analyze the fulfillment of sustainable development goal No. 16 to promote peaceful and inclusive societies for sustainable development, facilitating justice for all people, and creating effective, responsible, and inclusive institutions at all levels. The present research uses a systematic methodology through the analysis and review of jurisprudence, legal norms, and deductive theoretical doctrine with the integration of the legal explanatory, and projective methods. The review and analysis of ruling 98-23 JH/23 of the Constitutional Court is integrated, which analyzes the applicability of habeas corpus as a constitutional guarantee but not as a substitute measure for an executed sentence, the inter communis effect, and its very personal form of application finding a violation of the right to due process, legal certainty, access to the administration of justice, and the enforceability of the decision. Therefore, as a measure of restitution of these rights, the judges resolve to provide detailed information on the health conditions and environment of the persons deprived of their liberty and train judges at the national level on this criterion.
