Abstract

Abstract: In the topic addressed in this paper we are presented with the challenges that Ecuador faces, which refer to the search for justice and peace in the context as a search for social change, to the extent that violence must be eliminated, contextualized in the current social and cultural reality. This argument is aligned with Sustainable Development Goal (SDG) 16: Peace, justice and strong institutions , which seeks to build more peaceful and just social realities, with judicial integrity and due process being the mechanisms that make it possible to achieve this goal, especially when, on the one hand, justice systems not only guarantee a fair administration of justice, but are also necessary to achieve sustainability and social responsibility. The paper addresses how the Ecuadorian judicial system is responding to these challenges and focusing specifically on commercial law, but as I mentioned, focusing on private insurance, through an extraordinary action of protection provided for in Article 94 of the Constitution of the Republic of Ecuador. Although Ecuador has solid regulations, insurance companies do not use them in the best way and still elaborate practices that violate rights and interests of the insured, so the intervention of private insurance lawyers is required to try to end these injustices and restore confidence in the judicial system.
