| Abstract: | Abstract: This work, prior to obtaining the grade of Lawyer, deals with the study of a ruling issued by the Constitutional Court (CC) as part of the control the Court makes over the ruling on constitutional guarantees that are issued in the first and second instance, in order to generate judicial precedent. The ruling analyzed shows the violation of national laws and opens the door to an investigation into corruption in judicial system. The ruling is also studied in relation with the Sustainable Development Goals (SDG) promoted by the United Nations; in particular, the relationship with SDG No. 16, which deals with the topic Peace, Justice and Solid institutions. In order to carry out an adequate analysis, legal doctrine and national and international regulations were reviewed. The Sustainable Development Goals and documents related to their implementation in the country were also reviewed. |
| Description: | Resumen: El presente trabajo, previo a la obtención del título de Abogado, trata sobre el estudio de una sentencia emitida por la Corte Constitucional (CC) como parte del control que hace la Corte a las sentencias sobre garantías constitucionales que se emiten en primera y segunda instancia con el fin de generar jurisprudencia vinculante. La sentencia analizada, evidencia la vulneración a normativa nacional y abre la puerta a una investigación sobre corrupción en el sistema judicial. La sentencia también se estudia con relación a los Objetivos de Desarrollo Sostenible (ODS) promovidos por la Organización de las Naciones Unidas; en particular, se estudia la relación con el ODS N° 16, que trata el tema Paz, justicia e instituciones sólidas. Con la finalidad de hacer un adecuado análisis, se revisó doctrina jurídica y normativa nacional e internacional; también, se revisaron los Objetivos de Desarrollo Sostenible y documentos relacionados a su implementación en el país. |
