Abstract

Abstract: This thesis analyzes the ruling and selection of the preferred subject, ruling No. 393-17-EP/23, Extraordinary Protection Action filed by Geovanny Fidel López Tello, which declares a violation of the right to due process in the guarantee of the right to appeal a ruling in an inadmissibility decision regarding the criminal cassation appeal, based on Resolution No. 10-2015 of the National Court of Justice, whose unconstitutionality was declared in ruling No. 8-19-IN and accumulated/21. Its connection to the Sustainable Development Goal is primarily based on the type of crime that initiated this process, classified as femicide of the late Mrs. Edith Bermeo Cisneros (+), also known as Sharon La Hechicera. Given the media attention surrounding the case, the conviction was revised, overturning the initial ruling that classified the crime as negligent homicide in the case of Mr. Giovanny López, a decision made on June 30, 2015. The case concluded with a failure to uphold Article 76 of the Constitution of the Republic of Ecuador, which ensures the guarantee of due process,.
