Protección de los menores y la lucha contra la delincuencia juvenil en Ecuador

Abstract

Abstract: This thesis analyzes the protection of minors against the growing problem of juvenile delinquency in Ecuador, considering the structural causes that link them to organized crime and the shortcomings of the juvenile justice system. The research is based on a legal-dogmatic approach, using historical, analytical, deductive-inductive, hermeneutic, and exegetical methods, and applying documentary and comparative analysis techniques. The Organic Code for Children and Adolescents, the Comprehensive Organic Criminal Code, and various international instruments that emphasize the best interests of the child and differentiated criminal responsibility as fundamental guarantees will be critically examined. Likewise, the impact of the Public Integrity Law (2025), which introduces stricter regulations with punitive tendencies, is analyzed, generating concern among human rights organizations due to its potential violation of international standards.
