| Abstract: | Abstract: The topic of this research deals with the academic preferences of law students and their link with the Sustainable Development Goals through the study of a sentence of their own choice, in accordance with the general objective. In this degree work, different doctrines and jurisprudence are analyzed to feed the theoretical framework, in addition, a systematic and theoretical-deductive approach is used as methodology. The case study of this research is sentence 328-19-EP/20 of the Constitutional Court of Ecuador, it analyzes the effective judicial protection as a guarantee of the right to health of persons with disabilities and its relationship with Sustainable Development Goals number 3 and 16, through a doctrinal and constitutional study of the rights violated in this case. Finally, it is concluded that there is an institutional deficiency in the health and justice system; and, it is recommended that the public institutions of the Ecuadorian state need urgent reforms to guarantee an effective judicial protection, legal security and free access, especially the services of the Ministry of Public Health and Judicial Function. |
| Description: | Resumen: El tema de la presente investigación trata sobre preferencias académicas de los estudiantes de la carrera de Derecho y su vinculación con los Objetivos de Desarrollo Sostenible a través del estudio de una sentencia a elección propia, de conformidad al objetivo general planteado. En este trabajo de grado, se analiza diferentes doctrinas y jurisprudencia para alimentar al marco teórico, además, se utiliza un enfoque sistemáticoy teórico-deductivo como metodología. El caso de estudio de esta investigación es la sentencia 328-19-EP/20 de la Corte Constitucional del Ecuador, se analiza la tutela judicial efectiva como garantía del derecho a la salud de las personas con discapacidad y su relación con los Objetivos de Desarrollo Sostenible número 3 y 16, mediante un estudio doctrinal y constitucional de los derechos vulnerados en el presente caso. Finalmente, se concluye que existe deficiencia institucional en el sistema de salud y justicia; y, se recomienda que las instituciones públicas del estado ecuatoriano necesitan reformas urgentes para garantizar una tutela judicial efectiva, seguridad jurídica y acceso gratuito, especialmente los servicios del Ministerio de Salud Pública y Función Judicial. |
