| Abstract: | Abstract: In the development of this work analyzing the jurisprudence of the Constitutional Court, the critical study of the jurisprudential line concerning the guarantee of motivation within the right to due process was taken as a fundamental axis, its evolution regarding the standards to be met by judicial authorities, according to the jurisprudence of the Constitutional Court, considering that over the years and thanks to t2riterio2nent control of the Constitutional Court of Ecuador over judicial processes, this guarantee has been able to evolve, resulting in a unified criterion and establishing a consistent jurisprudential line. The general objective of this work is, then, to critically analyze the jurisprudential line of the Constitutional Court of Ecuador regarding the basic guarantee of motivation, conducting 2riterios2riterio on the Motivation Test and the rulings No. 1158-17-EP/21, 1852-21-EP/25, 2901-19-EP/23, considering that a correct motivation must contain2ritood interpretation, logical coherence, and clarity. 2riterio2nion, th2ritesis work provides several practic riterioria for adequate judicial motivation, which contributes to the effective protection of fundamental rights and the strengthening of the justice system in Ecuador. |
| Description: | Resumen: En el desarrollo del presente trabajo de análisis de la jurisprudencia de la Corte Constitucional se tomó como eje fundamental el estudio crítico de la línea jurisprudencial con respecto a la garantía de la motivación dentro del derecho al debido proceso, su evolución en cuanto a los estándares a cumplir por las autoridades judiciales, esto según la jurisprudencia de la Corte Constitucional, teniendo en consideración que a lo largo de los años y gracias al control permanente de la Corte Constitucional del Ecuador sobre los procesos judiciales, esta garantía ha podido evolucionar, lográndose en la actualidad un criterio unificado y estableciendo una misma línea jurisprudencial. El objetivo general de este trabajo es, entonces, analizar críticamente la línea jurisprudencial de la Corte Constitucional del Ecuador con respecto de la garantía básica de la motivación, realizando un análisis desde el Test de Motivación y de las sentencias No. 1158-17-EP/21, 1852-21-EP/25, 2901-19-EP/23, considerando que una motivación correcta debe contener una buena interpretación, lógica y clara. En conclusión, este trabajo de titulación brinda varios criterios prácticos para una adecuada motivación judicial, lo que contribuye a la protección efectiva de los derechos fundamentales y el fortalecimiento del sistema de justicia en Ecuado. |
