Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This curriculum integration project focuses on the study and evaluation of the motivation behind sentences handed down by first-instance judges, a selected sentence related to the crime of illicit trafficking in controlled substances is analyzed to identify its strengths and weaknesses in terms of legal and factual grounds. The findings reveal that, although minimum formal requirements are met, deficiencies persist in the comprehensive construction of arguments, which can compromise the clarity of the sentence and the exercise of the right to defense. In response, it is proposed to strengthen the continuing education of judges and create internal control mechanisms that allow for improved quality, consistency, and transparency in the reasoning of judicial decisions. In this way, the aim is to contribute to the improvement of the justice system and the strengthening of legal certainty. The main value of this research lies in offering a useful methodological tool to foster the continuous improvement of judicial practice, promoting a more just, efficient, and well-founded administration of justice.
