Libertad de expresión y sus límites en los estándares de comunicación contemporáneos en base al amparo constitucional

Abstract

Abstract: In this document, the new standards of contemporary communication that manifest in Ecuadorian society and their legal impact within jurisprudence will be determined. Additionally, the symbiosis that these media have in relation to legal elements will be identified and analysed, as well as the legal limits that manifest in the labour and social conduct of journalists as figures of communication and links between the State and Ecuadorian society. Although the current regulations indicate the existence of protective tools regarding fundamental rights for the development of individuals, it is important to highlight the limits present between freedom of expression and hate crimes or misinformation that may manifest through contemporary dissemination channels and that have a gigantic reach. For the conclusion of this project, an exegetical analysis of the resolutions of the Constitutional Court will be required to achieve a true comparison between the rulings issued and the communication standards with the highest protection of rights.
