Abstract

Abstract: This research addresses Sustainable Development Goal (SDG) 16: Peace, Justice and Strong Institutions, with emphasis on the analysis of institutional effectiveness in guaranteeing fundamental rights. The general objective was to evaluate the role of public institutions as agents of social transformation based on the study of Judgment No. 732-18-JP/22 issued by the Constitutional Court of Ecuador. The research was carried out in the province of Manabí and the case of Rosa, an adult over 80 years of age with a 75% disability, belonging to a priority care group, was taken as a reference. A qualitative approach was used using documentary and jurisprudential analysis as techniques. The instruments applied were the analysis of sentences and current regulations. The results reflect that the Civil Registry violated the rights to identity, due process, effective judicial protection, and access to justice by arbitrarily denying the renewal of the identity card. It is concluded that there are still obstacles that prevent access to rights, especially people in vulnerable situations.
