Los límites de la libertad de expresión en contextos electorales

Abstract

Abstract: The present research work titled "The Right to Freedom of Expression in Electoral Contexts" aims to determine the limits of the right to freedom of expression in electoral processes according to the jurisprudence issued by the Constitutional Court of Ecuador; for this purpose, a theoretical, doctrinal, and jurisprudential analysis has been conducted that not only establishes the importance of the right to freedom of expression but also its fundamental role in systems where representative democracy is the instituted system of government. Moreover, it is emphasized that this right is not reserved for a few, and it is imperatively necessary to promote public debate and the deliberative exercise of the population, who through freedom of expression, which not only constitutes the right to manifest but also to seek and disseminate information, can access not only a single type of information (sometimes biased) but also neutral and objective criteria that allow them to enrich their knowledge and make better decisions during electoral periods.
