Abstract

Abstract: This research analyzes the relationship between Sustainable Development Goal (SDG) 16, which promotes peace, justice, and the building of strong institutions, and Judgment No. 768-15-EP/20 issued by the Constitutional Court of Ecuador. This ruling accepted an Extraordinary Action for Protection against a decision by the National Court of Justice that aggravated the sentence imposed on the defendant during the cassation phase, violating the principle of non reformatio in peius (prohibition of worsening the situation of the sole appellant). The analysis seeks to demonstrate how respect for fundamental rights and due process contributes to a more just and peaceful society. Equitable access to justice is essential to avoid conflict, guarantee reparation for damages, and prevent structural violence. Peace is not only a social goal but also a necessary condition for economic and human development. Societies with effective and trustworthy judicial systems are less likely to suffer from violence and instability, factors that hinder growth and put human lives at risk. Therefore, strengthening justice is key to achieving SDG 16.
