Vulneración de Derechos Fundamentales en el Proceso Penal: Análisis de la Sentencia No. 393-17-EP23 de la Corte Constitucional del Ecuador

Abstract:The Judgment No. 393-17-EP/23 of the Constitutional Court of Ecuador resolved the extraordinary protection action filed by Geovanny Fidel López Tello, who claimed the violation of his right to due process in a femicide case. The Court determined that the guarantees of reasoning, the right to appeal decisions, and legal certainty had been violated, thus annulling previous judicial decisions and ordering a new analysis of the cassation appeal in compliance with the Constitution. This research is framed within SDG 16: Peace, Justice, and Strong Institutions, addressing the importance of access to appeal mechanisms and effective defense to strengthen a fair and impartial judicial system. Through the analysis of constitutional regulations, binding jurisprudence, and procedural background, irregularities compromising trust in judicial institutions were identified. The results highlight the need to ensure fairness, adequate reasoning in decisions, and transparency in judicial processes to promote a strong rule of law.
