| Abstract: | Abstract: The Constitutional Court's Ruling No. 732-18-JP/20 addresses one of the most significant social and legal concerns: the violation of the right to identity and other essential rights due to the annulment of a citizenship ID card by the Civil Registry. This decision was based on pre-existing information within its system. As a result of this administrative decision, the claimant was left without an identity document for two years, facing severe challenges related to freedom, well-being, and access to a dignified life. This study aims to take Ruling No. 732-18-JP/20 as a reference, analyzing its connection with the Sustainable Development Goals (SDGs), particularly SDG 16: Peace, Justice, and Strong Institutions. The objective is to recognize how public institutions can either safeguard or violate fundamental rights when individuals are in vulnerable situations. It also seeks to ensure that everyone has the right to free access to justice and effective judicial protection in administrative and judicial processes. Therefore, the rights of citizens will be upheld with a legal approach aligned with the Sustainable Development Goal No. 16. |
| Description: | Resumen: En la sentencia No. 732-18-JP/20 de la Corte Constitucional trata del interés social y jurídico más importante: la afectación del derecho a la identidad y de otros derechos esenciales, por la anulación de la cédula de ciudadanía, en este caso, por el Registro Civil a razón de la información que ya existe dentro de su sistema. Esta decisión administrativa dejó a la demandante por dos años sin cédula de identidad, enfrentando graves dificultades como la libertad, el buen vivir y el acceso a una vida digna. El presente trabajo pretende tomar como referencia la Sentencia No. 732-18-JP/20 desde la relación que guarda con los Objetivos de Desarrollo Sostenible (ODS), particularmente el ODS 16: Paz, Justicia e Instituciones Sólidas, para poder reconocer cómo las instituciones públicas pueden garantizar o violar derechos fundamentales cuando los sujetos están en estado de vulnerabilidad, y asegurar a toda persona el derecho al acceso gratuito a la justicia y a la tutela judicial efectiva en los procesos administrativos y judiciales. Por eso se garantizará el derecho de los ciudadanos con un enfoque legal, en concordancia con el objetivo de desarrollo sostenible No.16. |
