dc.descriptionResumen: El presente trabajo analiza la acción de hábeas data en el marco del constitucionalismo, estudiando su origen, naturaleza y los límites establecidos por la normativa y la jurisprudencia. Esta garantía constitucional permite acceder, actualizar, rectificar o eliminar datos personales, protegiendo así derechos fundamentales como la intimidad, el honor y la autodeterminación informativa. A partir de un estudio doctrinal y normativo, se aborda el fenómeno de la desnaturalización de esta acción, entendido como el uso indebido de la garantía para fines distintos a los previstos en la Constitución. El análisis se centra en la Sentencia No. 180 22 EP/24 de la Corte Constitucional del Ecuador, en la cual se determinó que jueces de instancias inferiores emplearon el hábeas data para declarar derechos de propiedad y anular resoluciones administrativas antiguas, excediendo el objeto de la acción y afectando la seguridad jurídica. El caso estudiado evidencia que el uso incorrecto de las garantías constitucionales no solo distorsiona el diseño institucional previsto en la Constitución, sino que también puede provocar vulneraciones al debido proceso y generar responsabilidades disciplinarias o penales para los jueces involucrados.es_ES
dc.description.abstractAbstract: This paper analyzes the writ of habeas data within the framework of constitutionalism, studying its origin, nature, and the limits established by regulations and jurisprudence. This constitutional guarantee allows for access, updating, rectification, or deletion of personal data, thus protecting fundamental rights such as privacy, honor, and informational self-determination. Based on a doctrinal and normative study, it addresses the phenomenon of the denaturalization of this writ, understood as the misuse of the writ of habeas data for purposes other than those provided for in the Constitution. The analysis focuses on Judgment No. 180 22 EP/24 of the Constitutional Court of Ecuador, which determined that lower court judges used habeas data to declare property rights and annul old administrative resolutions, exceeding the purpose of the writ of habeas data and affecting legal certainty. The case studied shows that the incorrect use of constitutional guarantees not only distorts the institutional design provided for in the Constitution, but can also cause violations of due process and generate disciplinary or criminal liability for the judges involved.es_ES
