Abstract

Abstract: This research focused on Sustainable Development Goal (SDG) 16: Peace, justice and strong institutions, examining how the lack of judicial motivation and the misuse of private power impact the effective judicial protection of fundamental rights. This study, carried out in the academic-legal field of Ecuador, was based on Judgment No. 533-15-EP/23 of the Constitutional Court of Ecuador. In addition, this case addressed the suspension of drinking water service by a private pre-association, which violated significant rights such as access to water and due process. On the other hand, an analytical-legal method was used with techniques of documentary analysis and interpretation of jurisprudence. The instruments used were data collection sheets and jurisprudential analysis matrices. Concluding that the protection of human rights requires solid institutions, reasoned judicial decisions and strict controls on the actions of individuals. Sustainable development is only possible if the justice system guarantees respect for rights, even when the violation comes from non-state actors.
