Abstract

Abstract:In this research work, the violation of the right to effective defense and protection and its link with sustainable development goal (SDG) number 16 is analyzed. When the 2008 Constitution came into force, many changes were evident, including the emergence of more jurisdictional guarantees, which ratifies the protection of the rights of the population, in the present study sentence, the violation of the right to effective protection and the right to defense can be evidenced in a first instance sentence issued by the Sixth Civil Court of Bolivar, rights that are stipulated in art 76 numeral 7 and art 75 of the Constitution of Ecuador, one of the duties of the administration of justice is to verify that there is no violation of rights, in the present case the Constitutional Court of Ecuador guarantees these rights and resolves to accept the extraordinary action of protection, which was qualified in compliance with what is established in Art. 61 of the Organic Law of Jurisdictional Guarantees and Constitutional Oversight, which establishes the requirements for filing a lawsuit when faced with a ruling that indicates a violation of rights. These guarantees have allowed Ecuador to maintain confidence in constitutional oversight. Therefore, strengthening judicial institutions should be a priority for the State, and, in accordance with the provisions of SDG 16, it should begin to implement measures that contribute to the effective administration of justice.
