Abstract

Abstract: This thesis focuses on the analysis of the judgment of Case No. 1229-14-EP by the Constitutional Court of Ecuador, which addresses a protection action filed by the religious entity "La Torre del Vigía-Ecuador" against the decision of the General Assembly of the Central Neighborhood of San Juan de Ilumán. This decision prohibited the construction of a place of worship for Jehovah's Witnesses, alleging violations of religious freedom and due process. The thesis examines the background of the case, the arguments presented by both parties, and the decision of the Constitutional Court, as well as the legal foundations and justifications used to reach the judgment. Additionally, it analyzes the errors made by the judges of the lower courts, specifically regarding the violation of the right to due process due to lack of motivation in their decisions. The impact of this judgment on the Ecuadorian legal system and its relevance to the protection of fundamental rights and religious diversity will also be discussed. Finally, a critical analysis of the judgment and a well-founded personal opinion will be offered. This thesis aims to provide a deep understanding of the importance of this case in the legal and social context of Ecuador.
