Abstract: This degree work, analyzes through comparative jurisprudence, conceptualizations and components of the right to free development of personality, and in the context of the constitutional sentence No. 916-22-JP/24, which are the limits imposed by the State to safeguard the institutional image. 916-22-JP/24, which are the limits imposed by the State to safeguard the institutional image, thus, we seek to establish whether the use of tattoos as part of the identity of a person who intends to join the Armed Forces, constitutes a limitation to be observed by society, where citizen confidence would be diminished by the mere fact of observing an appearance rather than an action. In addition, the real existence of the gap between the postulants and professional military personnel of the Armed Forces is analyzed, in the sense that, because the postulants have limits for their entry, while the professional military personnel, in the exercise of their rights, have no limitation to make use of tattoos.
