Abstract

Abstract: This paper addresses the violation of due process by the competent authorities in the case of plaintiff Yuber Efrén Cuenca Cuenca in the province of El Oro, in the ruling No. 510-20-EP/23, who, along with his defense attorney, appeared at the hearing, presenting arguments that supported the appeal before the Criminal and Traffic Chamber of the Provincial Court of Justice of El Oro, which was in charge of dismissing this appeal, considering that it was not properly substantiated and therefore the plaintiff should withdraw. However, the Constitutional Court accepted the extraordinary action of protection, which was presented within the framework of a criminal process, verifying the judicial conduct considered an unreasonable obstacle that prevented the plaintiff's right to appeal. It is worth mentioning that, for the analysis of the work, the systematic method based on theoretical-deductive research techniques was used, as well as the analysis and synthesis method, which leads to obtaining exploratory legal research in addition to the instruments The methods used in the degree work were the filing and the study of sentences through online research. Based on the analysis of the aforementioned sentence, it can be seen The lack of professionalism and knowledge in the analysis and applicability of articles from different legal bodies for decision-making and because it is linked through ODS 16 which refers to peace, justice and strong institutions, it is necessary that all citizens have access to justice, to dignified treatment in both public and private institutions where every process is legal, transparent, and where officials are empathetic, responsible, and effective in their performance, since the lack of access to justice, discrimination, or corruption can perpetuate inequalities, thus falling into a type of social injustice that prevents all required cases from being fulfilled impartially.
